Greene County district court, week ending March 24

In Greene County district court Edwin Molina Ochoa, 31, of Perry was sentenced March 23 to five years in prison after he changed his plea to guilty to a charge of criminal mischief- second degree. The prison term was suspended and he was placed on probation to the Iowa Department of Corrections for three years. Should the sentence be imposed, it will be consecutive to the sentence in another Greene County case on a charge of eluding. Molina Ochoa must pay $500 victim restitution. He was fined $1,025 with a $153.75 surcharge. Court costs were $167. Charges of theft- second degree and burglary- third degree motor vehicle were dismissed.

In a second case against Molina Ochoa, he was sentenced to two years in prison after he changed his plea to guilty to a charge of eluding- aiding and abetting, speed more than 25 mph over the limit. The prison term was suspended and he was placed on probation to the Department of Corrections for two years. The prison term will be consecutive to the term in the above case if it is served. He was fined $855 with a $128.25 surcharge; both were suspended. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $100 court costs.

In a third case initiated against Molina Ochoa a charge of harassment- first degree was amended to harassment- third degree. He was sentenced to 15 days in jail and fined $105 with a $15.75 surcharge. Court costs were $67. (Sentencing: Honorable Joseph B. McCarville in all three cases)

Douglas James Fulton Jr, 37, of Jefferson was sentenced to 180 days in jail, with all but two days suspended, after he changed his plea to guilty to a charge of operating while intoxicated. He was placed on probation to Boone/Greene County Probation for one year, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Fulton was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay an amount not to exceed $650 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

Luke Raymond Holinski, 26, of Jefferson was sentenced to two days in jail after he changed his plea to guilty to a charge of possession of marijuana. The jail term was suspended and he was placed on probation to Boone/Greene County Probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Holinski was fined $430 with a $64.50 surcharge. Court costs were $100. A case against Holinski in magistrate court in which he was charged with possession of drug paraphernalia was dismissed. He was assessed $60 court costs. (Sentencing: McCarville)

Brendan Joseph Hesser, 42, of Boone was sentenced to two years in prison after he changed his plea to guilty to a charge of fraudulent practice- third degree. The prison term was suspended and he was placed on probation to Boone/Greene County Probation for one year. Hesser was fined $855 with a $128.25 surcharge. He must pay $600 restitution for his court appointed attorney’s fees and $169.25 court costs. A charge of gambling- avoid setoff was dismissed. (Sentencing: McCarville)

Kenneth Eugene Hardman, 47, of Jefferson was sentenced to 180 days in jail after he changed his plea to guilty to sex offender registration violation. All but two days of the jail sentence was suspended and he was placed on probation to the Department of Corrections for two years. Hardman was fined $855 with a $128.25 surcharge. He must pay restitution not to exceed $600 for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

Adam Eugene Coy, 31, of Grand Junction pleaded not guilty March 24 to charges of attempted murder, domestic abuse assault with intent to inflict serious injury, and willful injury causing serious injury. A trial date was set for May 9.

Cases were initiated in district court as follows: Shelly Jo Brundage, 51, of Lehigh, possession of methamphetamine and possession of marijuana; Katelin Rae Lowmiller, 31, of Jefferson, theft- fourth degree; Devin Julian Villalobos, 21, of Jefferson, driving while license revoked; and Alex Garron Treft, 31, of Grand Junction, driving while license barred.
