Greene County district court, week ending Oct. 2

In Greene County district court Justin Joe Downs, 35, of Churdan was sentenced Sept. 28 to five years in prison after he pleaded guilty to a charge of burglary- third degree, amended from burglary- second degree. The prison term is consecutive to prison terms in another Greene County case. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. Downs was fined $750 with a $112.50 surcharge; both were suspended. A charge of false imprisonment was dismissed. The court found him unable to pay restitution for his court appointed attorney’s fees. Court costs were $100. (Sentencing: Honorable Steven J. Oeth)

Courtney Kern, 34, of Jamaica was sentenced to 10 days in jail on a charge of driving while license barred. She will receive credit for time served. Kern was fined $625 with a $93.75 surcharge; both were suspended. A hearing will be held on whether she is able to pay restitution for her court appointed attorney’s fees. Court costs were $100. Joshua Troy Smithson, 42, of Ladora received identical sentenced Sept. 29 on two separate charges of driving while license barred. In each case, he was sentenced to 30 days in jail. The jail term was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. He was fined $625 with a $93.75 surcharge; the fine and surcharge were suspended in both cases. He must pay a total of $664.50 restitution for his court appointed attorney’s fees and $222.90 court costs. (Sentencing: McCarville)

Christopher Hollis Christian, 40, of Fort Dodge was sentenced to 10 days in jail after he changed his plea to guilty to a charge of driving while license barred. He will receive credit for time served. He was fined $625 with a $93.75 surcharge; both were suspended. He must pay restitution for his court appointed attorney’s fees not to exceed $600. Daniel Ray Newton, 30, of Grand Junction was sentenced to one year in jail after he changed his plea to guilty to a charge of attempted burglary- third degree. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He was fined $625 with a $93.75 surcharge. He must pay restitution for his court appointed attorney’s fees not to exceed $600. Court costs were $136. (Sentencing: McCarville)

Steven Logan Dzuris, 32, of. Jefferson was sentenced to 20 days in jail on charges of assault on a peace officer and eluding. The jail terms are consecutive. He was fined $315 with a $47.25 surcharge on each charge. He must pay restitution not to exceed $600 for his court appointed attorney’s fees. Court costs were $100.

In a separate case, initiated one week after the first, Dzuris was sentenced to five years in prison on a charge of eluding or attempting to elude while participating in a felony, operating while intoxicated or committing a controlled substance violation. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. He was fined $750 with a $112.50 surcharge; both were suspended. He was also charged with interference with official acts abusing bodily injury in that case. On that charge he was sentenced to 20 days in jail, consecutive to the other two jail terms – Dzuris will serve 60 days in jail. He was fined $315 with a $47.25 surcharge; both were suspended. Dalton Weber, 22, of Scranton was sentenced to one year in jail after he changed his plea to guilty to a charge of domestic abuse assault- second offense. All but two days of the jail term was suspended and he was placed on probation to Boone/Greene County Probation for one year. He was fined $315 with a $47.25 surcharge and a $90 domestic abuse assault surcharge. He must pay no more than $600 restitution for his court appointed attorney’s fees. Charges of child endangerment and false imprisonment were dismissed. Court costs were $100. (Sentencing: McCarville)

Persons pleaded not guilty at arraignment as follows: Mark Christopher Frohwein, 23, of Churdan, possession of marijuana; and Matthew John Goff, 47, of Jefferson, criminal mischief- fourth degree and trespass. Trial dates were set for Dec. 8 in both cases.

Cases were initiated in district court as follows: Dawn Marie Brown, 49, of Perry, forgery; Nathaniel Clark Aldrich, 32, of Jefferson, willful injury causing serious injury and domestic abuse assault causing injury or mental illness; Peggy Sue Fulton, 58, of Ames, wanton neglect of healthcare facility resident; Jonathan David Law, 36, of Churdan, operating while intoxicated; and Dalton Weber, 22, of Scranton, supply alcohol to person under legal age (two counts).
