Greene County district court, week ending March 29

In Greene County district court Marlene Eleanor Anderson, 54, of Jefferson was sentenced to one year in jail after she changed her plea to guilty to a charge of possession of amphetamine. The jail sentence was suspended and Anderson was placed on probation to Boone/Greene County Probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $430 with a $64.50 surcharge. She was fined $105 with a $15.75 surcharge on a charge of theft- fifth degree, amended from theft- third degree. One count of possession of a controlled substance and two counts of unlawful possession of prescription drug were dismissed. The court found her unable to pay court costs or restitution for her court appointed attorney’s fees. (Sentencing: Honorable Joseph B. McCarville)

Linda Kay Cleary, 55, of Grad Junction was sentenced to two years in prison after she changed her plea to guilty to a charge of possession of methamphetamine- second offense. The prison term was suspended and she was placed on probation to Boone/Greene County Probation for two years. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Cleary was fined $855 with a $128.55 surcharge; both were suspended. She must pay $500 restitution for her court appointed attorney’s fees and $147.56 court costs. (Sentencing: McCarville)

James Michael Timmons, 44, of Jefferson was sentenced to one year in jail after he changed his plea to guilty to a charge of operating while intoxicated- second offense. All but seven days of the jail time was suspended, with credit for time served. The sentence is consecutive to another Greene County charge against Timmons of operating while intoxicated. He was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of four days of the jail time. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Timmons was fined $1,875 with a $281.25 surcharge. A charge of driving while license revoked was dismissed. Court costs were $100. (Sentencing; McCarville)

Michael David Husar, 64, of Churdan was sentenced to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but seven days of the jail sentence was suspended and he was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail time. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Husar was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay $51.10 restitution for his court appointed attorney’s fees. Court costs were $100. A charge of possession of dangerous weapon while under the influence was dismissed. (Sentencing: McCarville)

Information is available since the return of an arrest warrant that Austin James Hill, 36, of West Des Moines is charged with gambling- avoid setoff and conspiracy to commit non-forcible felony. Also, Tanya Marie Helmrichs, 44, of Grand Junction is charged with possession of methamphetamine- second or subsequent offense.

Cases were initiated during the week ending March 29 as follows: William Poio, 49, of Jefferson, operating while intoxicated; Kole Alexander Higgins, 29, of Grand Junction, driving while license barred; Christa Lynn Bluml, 39, of Glidden, operating while intoxicated; Suanne Elaine Winters, 52, of Bayard, driving while license revoked; and Jacob Robert Steward, 31, of Fort Dodge, assault causing bodily injury or mental illness.
