Shanda Jean Ellingson, 40, of Jefferson was sentenced Dec. 4 in district court to a total of 17 years in prison after being found guilty in a trial on the minutes of charges relating to the sex abuse of her two daughters and drug possession. Her husband, Benjamin James Ellingson, 38, of Jefferson was sentenced in June to a total of 55 years in prison on charges of distributing marijuana to a person younger than age 18. sexual exploitation of a minor/ cause to engage in sex act, sex abuse- third degree, and two counts of enticing a minor younger than 16 years of age for sexual purpose. According to court documents, Shanda Ellingson knew of the abuse, enabled her husband to commit sex abuse, participated in sex abuse, and was present while abusive acts occurred.
Shanda Ellingson was sentenced to 10 years in prison on a charge of sex abuse- third degree. She was fined $1,370 with a $205.50 surcharge. She was sentenced to five years in prison on a charge of possession with intent to deliver 50 kg or less of marijuana. She was fined $1,025 with a $153.75 surcharge; the fine and surcharge were suspended. She was sentenced to two years in prison on a charge of child endangerment. She was fined $855 with a $128.25 surcharge; the fine and surcharge were suspended.
All prison terms are consecutive. When she is eventually released from prison she will be under the supervision of the Iowa Department of Corrections as if on parole for the remainder of her life. She must also register on the Iowa Sex Offender Registry. She must pay a total of $1,311.47 in court costs. Charges of failure to affix drug tax stamp, willful injury causing bodily injury, domestic abuse assault- injury or mental illness, and unlawful possession of prescription drug were dismissed. A case in magistrate court in which Shanda Ellingson was charged with possession of drug paraphernalia and violation of a no contact order was dismissed. (Sentencing: Honorable Christopher C. Dillon Wayne Davis, 25, of Glidden was sentenced Dec. 7 to one year in jail after he changed his plea to guilty to a charge of operating while intoxicated- third offense. All but seven days of the jail term was suspended and he was placed on probation to Boone/Greene County Probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must complete a drinking drivers course. He may complete the Des Moines Area Community College 48-hour alcohol education program at his own expense in lieu of two days of the jail term. Davis was fined $1,875 with a $281.25 surcharge. Sarah Dawn Schwery, 47, of Jefferson was sentenced to one year in jail after she changed her plea to guilty to a charge of operating while intoxicated. All but two days of the jail sentence was suspended and she was placed on probation to Boone/Greene County Probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She must complete a drinking drivers course. She may complete the Des Moines Area Community College 48-hour alcohol education program at her own expense in lieu of the jail term. She was fined $1,250 with a $187.50 surcharge; one-half was waived as she has obtained a temporary restricted license. Karston Armen Ausborn, 23, of Lytton was sentenced to 180 days in jail after he pleaded guilty to a charge of OWI-first offense, amended from OWI-second offense. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must complete a drinking drivers course. He may complete the Des Moines Area Community College 48-hour alcohol education program at his own expense in lieu of the jail term. He was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Ausborn was sentenced to one year in jail after he changed his plea to guilty to a charge of possession of marijuana; all but one day was suspended, and the jail time is concurrent. He was fined $430 with a $64.50 surcharge. Ausborn must pay $500 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Devin Christopher Hackfort, 27, of Jefferson was sentenced to one year in jail after he pleaded guilty to a charge of assault on persons in certain occupations, amended from assault on persons in certain occupations- bodily injury. All but seven days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He was fined $430 with a $64.50 surcharge. He must also pay $492.40 restitution for his court appointed attorney’s fees and $100 court costs. A charge of interference with official acts- inflict bodily injury was dismissed. Kailee Kay Davidson, 23, of Boone was sentenced to one year in jail after she pleaded guilty to a charge of possession of methamphetamine- first offense, amended from possession of methamphetamine- second offense. The jail time was suspended and she was placed on probation to Boone/Greene County Probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $430 with a $64.50 surcharge. The court ruled she is unable to pay restitution for her court appointed attorney’s fees and court costs. A judgment for a $105 fine with a $15.75 surcharge was entered against Timothy Wayne Ray, 49, of Grand Junction after he pleaded guilty to a charge of disorderly conduct- abusive epithets/threatening gesture, amended from assault causing bodily injury or mental illness. Nathan Andrew Hubbs, 18, of Des Moines was sentenced to 30 days in jail after he pleaded guilty to a charge of assault- simple, amended from assault causing bodily injury or mental illness. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He was fined $105 with a $15.75 surcharge. Kyle Dean Rysavy, 25, of Jefferson was sentenced to seven days in jail after he changed his plea to a charge of possession of marijuana. He was fined $430 with a $64.50 surcharge. The court found him unable to pay restitution for his court appointed attorney’s fees and court costs. A related charge in magistrate court of possession of drug paraphernalia was dismissed, with a judgment for $60 court costs. He was sentenced to seven days in jail on a charge in magistrate court of violation of a no contact order; the jail terms are concurrent. He was fined $105 with a $15.75 surcharge. Todd Jr, of Springfield, IL, possession of marijuana; Kayleigh Lynn Anderson, 22, of Boone, possession of marijuana and serious injury by vehicle; Sierra Kimberly Szaflarski, 32, of Jefferson, possession of methamphetamine- second offense and possession of marijuana- second offense; Kory Chris Schubert, 54, of Jefferson, possession of marijuana- three counts, and delivery of marijuana- two counts; Alex Garron Treft, 32, of Grand Junction, driving while license barred; Akecheta Undiea Mark Hudnell, 36, of Boone, possession of marijuana- second offense; Anthony Charles Kennedy, 41, of Ames, possession of methamphetamine- third or subsequent offense; and Christopher Craig Edwards, 42, of Carroll, criminal mischief- third degree. Trial dates were set for Jan. 30 for Todd, Anderson and Edwards, and for March 5 for all other defendants named.
Cases were initiated in Greene County district court during the week ending Dec. 8 as follows: Cody Allen Gray, 18, of Winterset, harassment- first degree, three counts; Bryce Randal Delaney, 56, of Jefferson, burglary- third degree, and in a separate case, possession of methamphetamine and possession of marijuana; Christopher Craig Edwards, 42, of Carroll, assault on persons in certain occupation; Crystal Elizabeth Clear, 26, of Carroll, criminal mischief- third degree, interference with official acts- bodily injury, assault on persons in certain occupation- bodily injury, and assault on persons in certain occupations; Dakota Andrew Amos, 26, of Des Moines, sex offender registration violation and child endangerment- registered sex offender; Abigail Leeann Russell, 28, of Jefferson, sex offender registry violation and child endangerment- registered sex offender; and Jacob Ryan Brouwer, 23, of Jefferson, possession of marijuana.
