In Greene County district court Zachery Allen Waters-Rice, 26, of Jefferson was sentenced Feb. 28 on four of 12 charges filed against him after an incident in May 2022 in which he was alleged to have stolen a pickup truck containing firearms, threatened a man with a gun, and led law enforcement on a high-speed chase around the county. He was apprehended after his cell phone pinged his location in a garage in the 1200 block of S. Mulberry St in Jefferson. In a plea agreement, Waters-Rice pled guilty to charges of possession of short-barreled rifle or short-barreled shotgun, intimidation with a dangerous weapon, burglary- third degree, and eluding at speed more than 25 mph over the limit.
Waters-Rice was sentenced to a term not to exceed five years in prison on the firearm possession charge, five years in prison on the intimidation charge, five years in prison on the burglary charge, and two years in prison on the eluding charge. The five-year terms are consecutive, with the two-year term concurrent to the longer terms.
He was fined $1,025 with a $153.75 surcharge on the firearm possession charge, the intimidation charge, and the burglary charge. The fine and surcharge were suspended on the firearm and burglary charge. He must pay the fine and surcharge on the intimidation charge. He was fined $855 with a $128.25 surcharge on the eluding charge; the fine and surcharge were suspended. The court ruled Water-Rice is unable to pay restitution for his court appointed attorney’s fees and court costs.
Charges of attempted murder, dominion/control of firearm/offensive weapon by domestic abuse offender (two counts), going armed with intent, use of dangerous weapon in commission of a crime, operate motor vehicle without owner’s consent, assault while displaying dangerous weapon and possession of methamphetamine were dismissed. Jason M. Pirie was sentenced March 1 to a term not to exceed two years in prison after a jury found him guilty at a trial Jan. 25 of theft- third degree. Pirie left the courthouse during jury deliberation, an act which Judge Joseph McCarville wrote was “contemptuous” in his sentencing document. The prison term is consecutive to a 180-day sentence that was invoked in another Greene County case on which Pirie had been placed on probation. (The probation was revoked.) Pirie was fined $855 with a $128.25 surcharge; both were suspended. The court found him unable to pay restitution for his court appointed attorney’s fees or court costs, but he must pay $54.99 victim restitution. (Sentencing: Honorable Joseph B. McCarville)
Dausen Cordell Olberding, 290, of Manson was fined $855 with a $128.55 surcharge after he changed his plea to guilty to a charge of driving while license barred- habitual offender. The fine and surcharge were suspended. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Grace Holinski, 19, of Jefferson was sentenced to two days in jail after she changed her plea to guilty to a charge of possession of marijuana. The jail term was suspended and she was placed on probation to Boone/Greene County Probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $430 with a $64.50 surcharge. She must pay an amount not to exceed $600 restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows: Richard Leo Fay, 63, of Churdan, theft- second degree; Heather Marie Gulbranson, 42, of Manson, driving while license barred; John Clayton Cook, 55, of Fort Dodge, fraudulent practice- second degree and gambling- avoid setoff; Eddie Ray Simpson II, 57, of Boxholm, possession of marijuana- third or subsequent offense, and possession of methamphetamine- third or subsequent offense; Anthony Marrell Banks, 44, of Ankeny, driving while license barred; Jessica Nicole Baxter, 36, of Carroll, fraudulent practice- third degree and gambling- avoid setoff; Roger Allen Burnie Jr, 36, of Jefferson, possession of marijuana and possession of methamphetamine; Benjamin Harold Winborne, 34, of Churdan, driving while license barred; Shelli Joyce Larson, 60, of Callendar, fraudulent practice- second degree and gambling- avoid setoff; and Angela Louise Robbins, 50, of Carroll, fraudulent practice- second degree and gambling- avoid setoff. Trial dates were set for May 9 for Fay and Gulbranson, and for April 4 for the remaining defendants.
