Greene County district court, ending Jan. 22

In Greene County district court Dale Lee Spaulding, 52, of Ellsworth was sentenced Jan. 15 to five years in prison after he changed his plea to guilty to a charge of possession of contraband in a correctional facility. The prison term was suspended and he was placed on probation to the Iowa Department of Corrections for three years. Spaulding was fined $750 with a $112.50 surcharge. He must pay up to $1,200 restitution for his court appointed attorney’s fees. Court costs were $2,372.67. (Sentencing: Honorable Joseph B. McCarville)

Jerry Eugene Miller, 36, of West Des Moines was sentenced Jan. 22 to five years after he changed his plea to guilty to one county of burglary- third degree. The prison term is concurrent to prison terms in three Dallas County cases and two Polk County cases. He was fined $750 with a $112.50 surcharge; both were suspended. He must pay $6,350 victim restitution. The court found him unable to pay restitution for his court appointed attorney’s fees or court costs. One county of burglary-third degree and one count of theft- second degree were dismissed. (Sentencing: McCarville)

Nicklaus Andrew Harrison, 21, of Forest City was sentenced to 30 days in jail after he changed his plea to guilty to a charge of carrying weapon while under the influence. The jail term was suspended and he was placed on probation to the Greene County sheriff for one year. He was fined $430 with a $64.50 surcharge. A charge of assault causing bodily injury or mental illness was dismissed. Harrison must pay up to $900 restitution for his court appointed attorney’s fees. Court costs were $140. Shayla Nicole Stephenson, 31, of Grand Junction was sentenced Jan. 21 to one year in jail after she changed her plea to guilty to a charge of operating while intoxicated. All but 12 days of the jail time was suspended and she was placed on probation to Boone/Greene County Probation for one year. She may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail term. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Stephenson was fined $1,250 with a $187.50 surcharge; one half will be waived if she obtains a temporary restricted license. She must pay restitution not to exceed $400 for her court appointed attorney’s fees and $100 court costs. A charge of child endangerment was dismissed. (Sentencing: McCarville)

Terence Izauh Bingley, 21, of Jefferson was granted a deferred judgment after he pleaded guilty to a charge of possession of marijuana. He was placed on informal probation to the Greene County sheriff for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay a civil penalty of $430. Court costs were $100. A charge in magistrate court of possession of drug paraphernalia was dismissed. (Sentencing: McCarville)

Persons pleaded not guilty at arraignment as follows: Emily Ann Chiafos, 33, of Jefferson, possession of methamphetamine; Ryan Douglas Patterson, 40, of Jefferson, domestic abuse assault- second offense; Abigail Sturgeon, 21, of Ames, possession of marijuana; Danielle Janette Dalton, 37, of Jamaica, driving while license barred; and Elizabeth Roper, 18, of Churdan, possession of marijuana. A trial date of March 2 as set for Patterson. Trial dates of April 6 were set for all other defendants listed.

Information is available since the return of an arrest warrant that Scott Thomas Perdue, 44, of Ogden is charged with possession of methamphetamine. The warrant was issued Nov. 6 and returned Jan. 11.

Cases were initiated in district court as follows: Dale Lee Spaulding, 52, of Ellsworth, OWI; Nickalos Andrew Brown, 25, of Jefferson, possession of marijuana; Ryan Douglas Patterson, 40, fo Jefferson, burglary- second degree, and in a separate case, harassment- first degree and tampering with a juror or witness, and in a separate case, domestic abuse assault- second offense, and in a separate case, burglary- third degree; Andres Tejeda Perez, 30, of Webster City, driving while license barred; Jason Edward Trotter, 47, of Perry, theft- second degree, possession of stolen property, criminal mischief- fourth degree, and trespass causing more than $300 damage; NIcholas Joseph White, 40, of Newton, theft- second degree, possession of stolen property, criminal mischief- fourth degree, and trespass causing more than $300 damage; Sharlee Jean Royce, 30, of Grinnell, theft-second degree, possession of stolen property, criminal mischief- fourth degree, and trespass causing more than $300 damage; and Josie Debra Rivera, 25, of Harcourt, OWI- second offense and child endangerment (two counts).
