Greene County district court ending April 28

In Greene County district court Sylvester L Trotter, 32, of Carroll was sentenced April 24 to five years in prison after he changed his plea to guilty to a charge of operating while intoxicated- third offense. He will be given credit for time served. He must undergo a substance abuse evaluation and follow all recommendations until maximum benefits are attained. His driver’s license was revoked. Trotter was fined $3,125 with a $1,093.75 surcharge; one half will be suspended if he obtains a temporary restricted license. He must pay a $10 drug abuse resistance education (DARE) surcharge. A charge of driving while license barred was dismissed. The court found him unable to pay Category 2 restitution (sheriff’s fees, restitution for court appointed attorney’s fees, etc). Court costs were $186.80.

Devin Julian Villalobos, 18, of Jefferson was sentenced to two days in jail after he changed his plea to guilty to a charge of possession of marijuana. The jail time was suspended and he was placed on informal probation to the Greene County sheriff for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Villalobos was fined $315 with a $110.75 surcharge, a $10 DARE surcharge, and a $125 Law Enforcement Initiative surcharge. Court costs were $258.64.

Thomas Alexander Oyres, 40, of Jefferson was sentenced April 24 to 15 days in jail after he pleaded guilty in magistrate court to a charge of possession of drug paraphernalia. The jail time was suspended and he was placed on informal probation to the county sheriff for one year. He was fined $65 with a $22.75 surcharge, a $10 DARE surcharge, and a $125 LEI surcharge. Court costs were $90. In a departure from the usual, a companion case in district court  in which Oyres was charged with possession of methamphetamine was dismissed, with court costs assessed to the state. More typically, disposition is entered on the district court cases and the magistrate court case is dismissed. (Sentencing: McCarville)

Yasday Sorter, 29, of Des Moines was sentenced to 20 days in jail after he pleaded guilty to a charge of operating a motor vehicle without the owner’s consent, amended from theft- first degree. He was fined $625 with a $218.75 surcharge and a $125 LEI surcharge. Sorter was sentenced to two days in jail, concurrent) on a charge of possession of marijuana- second offense. He was fined $325 with a $110.25 surcharge, a $125 LEI surcharge and a $10 DARE surcharge.  A charge of driving while license barred was dismissed. Court costs were $1,195.

Damon David Joseph Zimpel, 30, of Scranton was sentenced to one year in jail after he changed his plea to guilty April 23 to a charge of OWI- first offense. All but two days of the jail term was suspended. He may receive credit toward the jail time for completion of a 48-hour weekend offender program. He must also complete a community college drinking drivers school at his own expense, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He was placed on probation for one year to Greene/Boone County Probation. Zimpel was fined $1,250 with a $437.50 surcharge and a $10 DARE surcharge. The court found him unable to pay Category 2 restitution. Court costs were $100. A magistrate case in which Zimpel was charged with two counts of theft- fifth degree was dismissed as part of a plea agreement.

Terri Loreen Riley, 59, of Boone was sentenced to 30 days in jail after she changed her plea to guilty to a charge of possession of methamphetamine. The jail time was suspended and she was placed on probation to the county sheriff for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Riley was fined $315 with a $110.75 surcharge, a $10 DARE surcharge, and a $125 Law Enforcement Initiative surcharge. The court found her unable to pay Category 2 restitution. Court costs were $136. A charge in magistrate court of possession of drug paraphernalia was dismissed.

Marlene Eleanor Anderson, 50, of Ralston was sentenced to four days in jail after she changed her plea to guilty to a charge of driving while license barred. She was fined $1,000 with a $350 surcharge. She must pay Category 2 restitution not to exceed $600. A charge of OWI- first offense was dismissed. Court costs were $100.

Keith Eugene Schaffer, 64, of Jefferson was sentenced to 30 days in jail after he changed his plea to guilty to a charge of driving while license revoked. The jail term was suspended and he was placed on informal probation for one year. He was fined $1,000 with a $350 surcharge. Court costs were $100.

Melynda Louise Weltha, 44, of Grand Junction was sentenced to four days in jail after she changed her plea to guilty to a charge of driving while license revoked. She will receive credit for time served. Weltha was fined $1,000 with a $350 surcharge. Court costs were $100.

Courtney Kern, 33, of Jamaica was sentenced to 10 days in jail after she changed her plea to guilty to a charge of driving while license revoked. She was fined $1,000 with a $350 surcharge; both were suspended. The court found Kern is unable to pay Category 2 restitution. Court costs were $100.

Tanner James Hagar, 25, of Jefferson was granted a deferred judgment after he changed his plea to guilty to a charge of possession of marijuana. He was placed on probation to Greene/Boone County Probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Hagar must pay a $315 civil penalty, a $125 LEI surcharge, $500 restitution for his court appointed attorney’s fees and $100 court costs. A companion case in magistrate court in which Hagar was charged with possession of drug paraphernalia was dismissed. Court costs in that case were $60.

Persons pleaded not guilty at arraignment as follows: Brooklyn Sage Podell, 21, of Grand Junction, domestic abuse assault causing injury or mental illness and possession of marijuana; Julie Ann Bentz, 20, of Jefferson, possession of marijuana; and Jared Andrew Krause, 21, of Carroll, OWI- first offense.

Cases were initiated in district court as follows: Andrew Steven Gathercoal, 26, of Grand Junction, possession of marijuana; Daniel Ray Newton, 21, of Grand Junction, attempted burglary- third degree; and Matthew John Goff, 46, of Jefferson, assault causing bodily injury or mental illness and trespass causing injury or damage more than $300.
