Greene County district court, week ending Oct. 25

In Greene County district court Curtis Wesley Jurgensen, 55, of Woodward was sentenced Oct. 18 to 60 days in jail after he changed his plea to guilty to a charge of possession of marijuana- second offense. All but six days of the jail term was suspended and he was placed on probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Jurgensen was fined $750 with a $262.50 surcharge; both were suspended. He must pay a $10 DARE (drug abuse resistance education) surcharge and a $120 Law Enforcement Initiative surcharge. He must also pay $1,200 restitution for his court appointed attorney’s fees and $187.20 court costs. (Sentencing: Honorable Joseph B. McCarville)

Patricia Lynn Monthei, 51, of Panora was sentenced Oct. 25 to five years in prison after she changed her plea to guilty to a charge of operating while intoxicated- third offense. All but 30 days of the prison term was suspended and she was placed on probation for one year. She must follow the recommendations of a substance abuse evaluation she has already undergone, and she must complete a community college drinking drivers school. Monthei was fined $3,125 with a $1,093.75 surcharge. Court costs were $140. (Sentencing: McCarville)

Melynda Louise Weltha, 43, of Grand Junction was sentenced to nine days in jail after she changed her plea to guilty to a charge of OWI- first offense. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Weltha was fined $1,250 with a $437.50 surcharge; one-half will be waived if she gets a temporary restricted license.

Disposition was also entered in three cases against Weltha in Greene County magistrate court. In the first case, Weltha pleaded guilty to a charge of assault, amended from domestic abuse assault. She was sentenced to five days in jail and fined $65 with a $22.75 surcharge.

In the second case, Weltha was sentenced to seven days in jail after she pleaded guilty to a charge of violation of a no contact order. No fine was entered against her.
The three jail terms are consecutive. Judge McCarville found Weltha is unable to pay restitution for her court appointed attorney’s fee. A judge was entered for $60 court costs in one case.

In the third magistrate case, a charge of theft- fifth degree was dismissed.

Persons pleaded not guilty as follows: Christopher Hollis Christian, 39, of Marshalltown, driving while license barred; Laurann Joyce Perry, 23, of Perry, driving while license barred; Joel Robert Simpson, 64, of Jefferson, OWI- third offense; and Bruce K. Binkley, 58, of Jefferson, OWI- first offense. Trial dates were set for Dec. 10 for Christian and Simpson, and for Jan. 28 for Perry and Binkley.

Cases were initiated in district court as follows: Brittany Kay Smithy, 32, of Jefferson, possession of methamphetamine and possession of marijuana; Dale Lee Spaulding, 51 of Ellsworth, possession of contraband in correctional facility (two counts); and Dakota Bradley Barrett, 19, of Grand Junction, burglary- second degree. Barrett was also charged in magistrate court with theft- fifth degree in each of two cases.
