In Greene County district court judgment for a $105 fine with a $15.75 surcharge was entered Sept. 1 against Duane Edward Forkner, 59, of Jefferson, on a charge of disorderly conduct, amended from assault causing bodily injury or mental illness. Ryan James Brown, 54, of Jefferson was sentenced to two years in prison after he changed his plea to guilty to a charge of driving while license barred. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. If Brown ever serves the prison term, it will be consecutive to terms in two other Greene County cases. He was fined $855 with a $128.25 surcharge; both were suspended. He must pay an amount not to exceed $500 for his court appointed attorney’s fees and $100 court costs. Judgment was entered in a companion case in magistrate court. Brown was fined $250 with a $37.50 surcharge on a charge of interference with official acts. Court costs were $60 in that case. (Sentencing: McCarville)
Yvonne Marie Locke, 51, of Jefferson was granted a deferred judgment after she changed her plea to guilty to a charge of possession of marijuana. She was placed on probation to Boone/Greene County Probation for one year, and she must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She must pay a $430 civil penalty, restutition not to exceed $400 for her court appointed attorney’s fees, and $100 court costs. A charge in magistrate court of gathering where marijuana is used and possession of drug paraphernalia was dismissed. (Sentencing: McCarville)
Jonathan Ray Wittrock, 54, of Carroll was sentenced to two years in prison after he changed his plea to guilty to a charge of possession of methamphetamine- second offense. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. He was fined $855 with a $128.25 surcharge; both were suspended. Jeremy Wayne Alvis Beason, 28, of Jefferson was sentenced to two years in prison after he pleaded guilty to a charge of domestic abuse assault with intent to cause serious injury, amended from domestic abuse assault impeding air/blood flow causing bodily injury. All but two days of the prison term were suspended and he was placed on probation to the Department of Correctional Services for two years. He must also compete a batterers treatment program at his own expense. He was fined $855 with a $128.25 surcharge, and he must pay a $90 domestic abuse surcharge. Jay Dean Thede, 49, of Churdan was sentenced to two years in prison after he pleaded guilty to a charge of child endangerment, amended from child endangerment causing bodily injury. The prison term was suspended and he was placed on probation to the Department of Correctional Services for two years. Thede was fined $855 with a $128,25 surcharge; both were suspended. He must pay an amount not to exceed $500 restitution for his court appointed attorney’s fees and $171.50 court costs. (Sentencing: McCarville)
Brian R. Weltzin, 30, of Grand Junction was sentenced to five years in prison after he pleaded guilty to a charge of criminal mischief- second degree. He was fined $1,025 with a $153.75 surcharge; both were suspended. He must pay $1,521 restitution to Greene County Conservation. Weltzin was sentenced to two years in prison on a charge of operating while intoxicated- second offense. He was fined $1,875 with a $281.25 surcharge. The prison terms are concurrent, but consecutive to terms in one magistrate case, one felony charge, and one OWI charge. He must complete a substance abuse evaluation and any recommended treatment, as well as a drinking drivers course. The court found him unable to pay restitution for his court appointed attorney’s fees and court costs. A charge of driving while license revoked was dismissed. Additionally, Weltzin’s probation was revoked in three separate cases involving charges of possession of a dangerous weapon while intoxicated, criminal mischief- third degree, and driving while intoxicated- first offense. Persons pleaded not guilty at arraignment was follows: Julie Ann Simms, 59, of Carroll, possession of a controlled substance- third or subsequent offense and possession of marijuana- second offense; Brooke Ann Coffin, 31, of Scranton, operating while intoxicated- first offense; Jason Dale Charlet, 53, of Minburn, driving while license barred; and Jeffrey D. Sprague, 49, of Jefferson, harassment- first degree. Trials were set for Nov. 3 in every case.
