In Greene County district court Robert E. Barnard Jr, 57, of Des Moines was sentenced to five years in prison after he changed his plea to guilty to a charge of dominion/control of firearm/offensive weapon by a felon. The prison term was suspended. He was fined $1,025 with a $153.75 surcharge. He was sentenced to two days in jail and fined $100 with a $15 surcharge after he changed his plea to guilty to a charge of possession of marijuana. The jail time was suspended and he was placed on informal probation to the Greene County sheriff for one year. A charge of dominion/control of firearm by domestic abuse offender was dismissed. Barnard must pay restitution for his court appointed attorney’s fees not to exceed 4500 and $136.50 court costs. Morquett Borlin Jackson, 38, of Fort Dodge was sentenced to five years in prison after he changed his plea to guilty to a charge of passing winning wager to another person. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. He was fined $1,025 with a $153.75 surcharge. A charge of fraudulent practice- second degree was dismissed. Jackson must pay victim restitution to be determined and an amount not to exceed $600 restitution for his court appointed attorney’s fees. (Sentencing: McCarville)
Alexis Hannah Free, 28, of Bayard was fined $105 with a $15.75 surcharge after she pleaded guilty to a charge of theft- fifth degree, amended from burglary- third degree motor vehicle. She was placed on probation to Boone/Greene County probation for one year. She must pay an amount not to exceed $500 restitution for her court appointed attorney’s fees and $144.67 court costs. A charge of possession of marijuana against Gene Dillavou, 43, of Jefferson was dismissed, although he must pay $100 court costs. In a companion case in magistrate court, Dillavou was fined $105 with a 415.75 surcharge for possession of drug paraphernalia. Court costs were $60 in that case. (Sentencing: McCarville)
Joseph Allen Gilpin, 40, of Monroe was sentenced to one year in prison after he pleaded guilty to a charge of operating while intoxicated- second offense, amended from OWI- third offense. All but 30 days of the prison term was suspended. He was fined $3,125 with a $468.75 surcharge. He was also sentenced to two years in prison after changing his plea to guilty to a charge of driving while license barred. The prison term was suspended. If he eventually serves the prison sentences, they will be consecutive. He was placed on probation to the Iowa Department of Correctional Services for two years. He was fined $855 with a $128.25 surcharge; both were suspended. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay an amount not to exceed $500 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Bailey Kendahl Barney, 25, of Jefferson was sentenced to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hr alcohol education program in lieu of the jail time. Barney was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $100. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows: Isabell Rose Clark, 19, of Madrid, assault causing serious injury, willful injury causing serious injury, and going armed with intent; and Ryan James Brown, 51, of Jefferson, driving while license barred and eluding, and in another case, driving while license barred. A trial date was set for Dec. 12 for Clark and for Oct. 31 for Brown.
