In Greene County district court Joseph Robert Hupp, 30, of Scranton was sentenced Dec. 21 to five years in prison after he changed his plea to guilty to a charge of operating while intoxicated- third offense. All but 30 days of the incarceration was suspended and he was placed on probation to the Iowa Department of Corrections for three to five years. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must also complete the Des Moines Area Community College 48-hour alcohol education program. Hupp was fined $23,125 with a $468.75 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $100. (Sentencing: Honorable Joseph B. McCarville)
Trent Richard Leners, 25, of Lake City was sentenced to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated- first offense. All but two days of the jail sentence was suspended. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He may complete the DMACC 48-hour alcohol education program in lieu of the jail time. Leners was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $100. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows: James Kenneth Harris, 35, of Woodward, driving while license barred and operating vehicle without owner’s consent; Shane Franklin Clark, 43, of Rodney, operating vehicle without owner’s consent; Edwin Molina Ochoa, 30, of Perry, theft- second degree, and burglary- third degree motor vehicle; Anthony Joseph Nunez, 55, of Jefferson, domestic abuse assault causing injury or mental illness; Olvin Rodanin Aguilar Flores, 42, of Jefferson, sex abuse- continuous sex abuse of child, two counts, and Michael Jon Molle, 53, of Bagley, operating while intoxicated. Trial dates were set for Feb. 14 for Clark, Molina Ochoa and Nunez, and for Feb. 28 for Harris, Aguilar Flores and Molle.
Information is available since the return of an arrest warrant that Curtis Patrick Carr, 49, of Sioux City is charged with burglary- third degree, theft- second degree, and criminal mischief- third degree. The date of the offense is 6/11/2020. The arrest warrant was returnee Dec. 21.
