In Greene County district court Brandon Lee Kious, 37, of Jefferson was sentenced to five years in prison after he pleaded guilty to a charge of theft- second degree, amended from theft- first degree. The prison term was suspended and he was placed on probation to the Iowa Department of Corrections for three years. He must undergo substance abuse and gambling addiction evaluations and complete any recommended treatment at his own expense. He was fined $1,025 with a $153.75 surcharge, and he must victim restitution.
Kious was sentenced to 14 days in jail after he pleaded guilty to a charge of criminal mischief- fifth degree, amended from criminal mischief- fourth degree. The sentences are concurrent. On that charge a judgment was entered for a $105 fine with a $15.75 surcharge. Court costs were $301.93. (Sentencing: Honorable Gina C. Badding)
Persons pleaded not guilty at arraignment as follows: Josie Debra Rivera, 25, of Harcourt, operating while intoxicated- second offense and child endangerment (two counts); Edward Lee Goff, 19, of Jefferson theft- third degree; and Todd Allan Grimsman, 35, of Fort Dodge, burglary- third degree (two counts). Trial dates were set for May 11 in every case.
Information is available since the return of an arrest warrant that Samantha Isabel Menjivar, 19, of Coon Rapids has been charged with OWI- first offense. The warrant was issued Jan. 19 and returned May 26.
Cases were initiated in district court as follows: Brandon Lee Kious, 37, of Jefferson, possession of a controlled substance- second offense; Martin John Tolsdorf, 56, of Grand Junction, possession of methamphetamine- third or subsequent offense; and Paul Erick Waugh, 57, of Radcliffe, theft- first degree, dependent adult abuse/exploitation grater than $100, and ongoing criminal conduct.
