Greene County district court, week ending Jan. 16

In Greene County district court disposition was entered in a pair of cases against Melanie Marie Smith, 26, of Jefferson. In the earlier case, initiated Sept. 7, she was charged with possession of marijuana, gathering where marijuana is used, possession of methamphetamine, and gathering where controlled substances are used. She pleaded guilty to first two charges. On the possession of marijuana charge she was sentenced to 180 days in jail. The jail term was suspended and she was placed on probation to the Iowa Department of Correctional Services for two years. She must undergo a substance abuse evaluation and complete any recommended treatment. She was fined $430 with a $64.50 surcharge. On the gathering charge, she was sentenced to one year in jail, with credit for time served. The sentence was suspended. She was fined $430 with a $564.50 surcharge. Both charges related to methamphetamine were dismissed. A charge in magistrate court of possession of drug patraphernalia was also dismissed. Smith must pay $117 restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: Honorable Joseph B. McCarville)

The second case against Smith was initiated Nov. 30; the warrant was served Dec. 9. In that case she was charged with possession of methamphetamine and gathering where controlled substances are used. On the gathering charge, a judgment was entered for a $1,025 surcharge with a $153.75 surcharge; both were suspended. She was sentenced to prison for five years. The prison term was suspended; if it is ever served it will be concurrent to the sentence in a case in which she was charged with accessory after the fact, and consecutive to the sentence in the marijuana charge above. She was placed on probation to the Iowa Department of Correctional Services for two years. A charge of possession of methamphetamine was dismissed. Smith must pay an amount not to exceed $500 in restitution for her court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

A case was initiated in district court against Michael Paul Hanlon, 38, of Paton on a charge of harassment- first degree.
