In Greene County district court Jesus Marin Garcia, 39, of New Ulm, MN, was sentenced March 4 to 10 years in prison after he pleaded guilty to a charge of sex abuse- third degree, amended from sex abuse- second degree. He was fined $1,370 with a $205.50 surcharge and a $90 sex abuse surcharge. Marin Garcia was sentenced to five years in prison on a charge of lascivious acts with a child, with the sentences concurrent. Additional special sentencing places him under supervision as if on parole for the remainder of his life. He was fined $1,025 with a $253.75 surcharge on the lascivious acts charge; both were suspended, but he must pay a $250 civil penalty. Marin Garcia will be on the Iowa Sex Offender Registry for the remainder of his life. The court found him unable to pay restitution for his court appointed attorney’s fees and court costs. Joe Edward Blackmon, 48, of Yale was sentenced March 7 to three years in prison on a charge of possession of a controlled substance- third or subsequent offense. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. A judgment was entered for a $1,025 fine with a $153.75 surcharge. Blackmon was sentenced to seven days in jail on a charge of unlawful possession of prescription drug. The jail term was also suspended, but the two terms of incarceration will be consecutive if they are eventually served. Blackmon was fined $430 with a $64.50 surcharge on the prescription drug charge. He must also pay $950 restitution for his court appointed attorney’s fees. Two counts of possession of a controlled substance- third or subsequent offense and one count of unlawful possession of a prescription drug were dismissed. (Sentencing: Honorable Joseph B. Audrie Leiann Lawrence, 23, of Jefferson was sentenced March 6 to five years in prison after she changed her plea to guilty to a charge of possession of methamphetamine- third or subsequent offense. The prison term was suspended and she was placed on probation to the Iowa Department of Correctional Services for two years. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Lawrence was fined $1,025 with a $253.75 surcharge. A charge of possession of marijuana- third or subsequent offense was dismissed. She must pay $500 restitution for her court appointed attorney’s fees and $100 court costs. A charge in magistrate court of possession of drug paraphernalia was also dismissed. Court costs in that case were $60. (Sentencing: McCarville)
Viatcheslav Zakjevskii, 40, of Ames was sentenced to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but seven days of the jail sentence was suspended and he was placed on probation to the Iowa Department of Correctional Services for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must complete a community college drinking drivers school. In lieu of two days of the jail time he may complete the Des Moines Area Community College 48-hour alcohol education program at his own expense. Zakjevskii was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $100. (Sentencing: McCarville)
James Leon Cunningham, 49, of Jefferson was sentenced to five years in prison on a charge of possession of a controlled substance- third or subsequent offense. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. He is to reside in a residential correctional facility until he attains maximum benefits. A judgment for a $1,025 fine with a $153.75 surcharge was entered in that case. The court found him unable to pay restitution for his court appointed attorney’s fee and court costs. In another case, Cunningham was charged with introducing contraband into a correctional facility. He was sentenced to five years in prison, consecutive to the term in the above case. The prison sentence was suspended and he was placed on probation to the Department of Correctional Services for three years with the same stipulation of a residential correctional facility. Wenger 35, of Beaver, false report of indictable offense to public entity; Harmony Nicole Thompson, 25, of Jefferson, possession of marijuana, controlled substance violation, and unlawful possession of prescription drug; Larry Deana Bush, 59, of Churdan, operating while intoxicated and child endangerment- three counts; Whitney Case, 37, of Jefferson, domestic abuse assault causing injury or mental illness; Star N. Gifford, 32, of Jefferson, operating while intoxicated; Michael Lee Eastman, 50, of Jefferson, harassment- first degree; and James Kenneth Harris, 37, of Woodward, driving while license barred. Trial dates were set for April 9 for Case and Beaty, and for May 14 for all other defendants.
