In Greene County district court Carlos Carmelo Sierra Rojas, 25, of Des Moines was sentenced March 28 to 29 days in jail after he pleaded guilty to a charge of operating while intoxicated- second offense. The jail term is concurrent to the sentence in another case in which a jury found Sierra Rojas guilty of a charge of assault on a peace officer. He was fined $430 with a $64.50 surcharge on the assault charge, and $1,875 with a $281.25 surcharge. The court ruled he is unable to pay restitution for his court appointed attorney’s fees or court costs. (Sentencing: Honorable Joseph B. McCarville)
Persons pleaded not guilty as follows: Richard Dean Tuhn Jr, 43, of Jefferson, unlawful possession of prescription drug; Shawn Lee King, 31, of Grand Junction, ongoing criminal conduct- influence enterprise, possession of methamphetamine- first offense, and controlled substance violation; Hope Rebecca Malone, 42, of Jefferson, possession of marijuana; and Ted Lawrence Semke, 44, of Boone, possession of marijuana. Trial dates were set for June 7 for Tuhn, Malone and Semke, and for June 14 for King.
Cases were initiated in district court as follows: David Robert Kersey, 50, of Ames, gambling- false claim of winnings; Robert Craig Montgomery, 67, of Grand Junction, conspiracy to commit non-forcible felony; Christopher Robin Lawrence, 21, of Jefferson, OWI- second offense; Eric Wayne Bellinghausen, 41, of Jefferson, OWI-first offense; Michael Shane Miller, 51, of Jefferson, possession of marijuana and conspiracy to manufacture/deliver marijuana less than 50kg; and Peyton Michael Paddock, 24, of Jefferson, OWI- first offense.
