Greene County district court, week ending Nov. 19

In Greene County district court Brendan Robert James, 21, of Bouton was sentenced Nov. 18 to 1 year in jail after he changed his plea to guilty to a charge of operating while intoxicated- first offense. All but two days of the jail term was suspended and he was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of the jail time. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. James was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay an amount not to exceed $1,000 restitution for his court appointed attorney’s fees and $331.82 court costs. (Sentencing: Honorable Joseph B. McCarville)

Danny Wayne Fees, 30, of Des Moines was sentenced to six months in jail after he changed his plea to guilty to a charge of possession of methamphetamine- second offense. All but seven days of the jail term was suspended and he was placed on probation for one year to the Iowa Department of Correctional Services. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Fees was fined $855 with a $128.25 surcharge. Court costs were $250.06. A charge of possession of marijuana- second offense was dismissed. (Sentencing: McCarville)

Erica Kay Murphy, 30, of Jefferson was sentenced to five days in jail after she pleaded guilty to a charge of disorderly conduct, amended from assault on persons in certain occupations causing bodily injury. She was fined $105 with a $15.75 surcharge. Court costs were $100. A charge of disorderly conduct- abusive epithet/threatening gesture was dismissed. (Sentencing: McCarville)

Austin Gregory Romberg, 21, of Newton was sentenced to five days in jail after he changed his plea to guilty to a charge of driving while license revoked. The jail time was suspended and he was placed on informal probation to the Greene County sheriff for one year. Romberg was fined $1,000 with a $150 surcharge. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $140 court costs. (Sentencing: McCarville)

Luke J. Blakeman, 29, of Perry was sentenced to six days in jail after he changed his plea to guilty to a charge of OWI. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail time. If he serves the entire six days in jail he must complete a 12-hour impaired drivers education course. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Blakeman was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. Court costs were $140. A charge of child endangerment was dismissed. Damien James Comstock, 26, of Woolstock was sentenced to 10 days in jail after he changed his plea to guilty to a charge of driving while license barred. If he obtains a temporary restricted license the court may suspend the jail sentence. Comstock was fined $855 with a $128.25 surcharge; both were suspended. He must pay $600 restitution for his court appointed attorney’s fees and $140 court costs. (Sentencing: McCarville)

William Matthew Magneson Jr, 26, of Woodward was sentenced to five years in prison after he pleaded guilty to a charge of eluding while participating in a felony, amended from eluding at speed of 25 mph over the limit second or subsequent offense. The prison term was suspended and he was placed on probation to the Iowa Department of Correctional Services for three years. He was fined $750 with a $112.50 surcharge; both were suspended. Magneson also changed his plea to guilty to a charge of OWI. He was sentenced to one year in jail; all but two days were suspended and he was placed on probation to DOCS for one year. He may complete the DMACC 48-hour alcohol education program in lieu of the jail time. If he serves the two days in jail he must complete a12-hour impaired drivers education course. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. A charge of possession of a controlled substance- second offense was dismissed. Magneson must pay an amount not to exceed $1,200 restitution for his court appointed attorney’s fees and $140 court costs. (Sentencing: McCarville)

Persons pleaded not guilty at arraignment as follows: Nyadhour Riek Deng, 23, of San Diego, CA, unlawfully manufacture, deliver or possess with intent to manufacture or deliver marijuana, not more than 50 kg, and failure to affix tax stamp; Luke Elwin Molle, 23, of Jamaica, possession of marijuana and possession of contraband in a correctional facility; and Derek Eugene Ott, 30, of Fort Dodge, possession of marijuana and possession of methamphetamine. Trial dates were set for Jan. 25, 2022, in every case.

Information is available since the return of arrest warrants that Kage Tyler Gordon, 25, of Howell, NJ, has been charged with child endangerment causing serious injury; and in a separate case, conspiracy to commit forcible felony (two counts), conspiracy to commit non-forcible felony, and conspiracy to commit aggravated misdemeanor.
