In Greene County district court William Russell Griffin, 46, of Rippey was found guilty of two counts of stalking at a jury trial that began Aug. 24 and ended Aug. 30. Sentencing on those two counts is scheduled for Sept. 27. The jury found him not guilty of criminal mischief- first degree and trespass causing injury or damage greater than $300. The case was initiated in August 2020.
Jaime Candelario Mercado, 39, of Webster City was sentenced Aug. 31 to five years in prison after he changed his plea to guilty to a charge of operating while intoxicated- third or subsequent offense. The prison term is concurrent to a sentence in a federal case. Candelario Mercado was fined $3,125 with a $468.75 surcharge. (Sentencing: Honorable Joseph B. McCarville)
Elizabeth Danail Nicole Ficken, 37, of Centerville was sentenced to five years in prison after she pleaded guilty to one count of theft- second degree. The prison term was suspended and she was placed on probation to the Iowa Department of Corrections for five years. If she ever serves the prison term it will be consecutive to terms in Story and Cerro Gordo counties. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Ficken was fined $759 with a $112.50 surcharge; both were suspended. She must pay an amount not to exceed $1200 restitution for her court appointed attorney’s fees and $754.42 court costs. Charges of burglary- third degree and criminal mischief- third degree were dismissed.
Randall Craig Clark, 58, of Webster City was sentenced to 10 days in jail after he changed his plea to guilty to a charge of driving while license barred. The jail time will be suspended and he’ll be placed on informal probation if he obtains a valid driver’s license prior to Oct. 6. Clark was fined $855 with a $128.25 surcharge; both were suspended. He must pay an amount not to exceed $600 for his court appointed attorney’s fees and $140 court costs. (Sentencing: McCarville)
Victoria Leigh Ann Gordon, 21, of Jefferson was sentenced Aug. 31 to 10 years in prison after she changed her plea to guilty to a charge of sexual exploitation of a minor, Class C felony. The prison term was suspended and she was placed on probation for five years to the Iowa Department of Corrections. She must register as a sex offender and will be under supervision as if on parole for the rest of her life. Gordon was fined $1,620 with a $205.50 surcharge. Court costs were $171.50. Charges of child endangerment, lascivious acts with a child, and sex abuse- third degree were dismissed. (Sentencing: Honorable Thomas J. Bice)
Brian Jeffery Burris, 43, of Scranton was sentenced to one year in jail after he changed his plea to guilty to a charge of OWI- first offense. All but two days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of the jail time. Burris was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows: Anthony Robert Booth, 30, of Perry, criminal mischief third degree, trespass causing injury or damage more than $300, burglary- third degree, and theft- second degree; Sarah Johanna McBurney, 39, of Fort Dodge, theft- third degree; Jon Mitchell Bushman, 44, of Scranton, OWI- second offense; Kyle Thomas Huinker, 50, of Tea, SD, OWI- first offense; and Michelle Ann Cook, 22, of Jefferson, possession of marijuana. Trial dates were set for Nov. 2 in every case.
Cases were initiated in district court as follows: Joshua Abraham Solano, 26, of Guthrie Center, possession of methamphetamine; Richard Dean Tuhn Jr of Grand Junction, illegal operation of motor vehicle in stream bed; Jessica Lea Duong, 29, of Jefferson, domestic abuse assault causing bodily injury or mental illness, and assault causing bodily injury or mental illness; Jose Zeferino Hernandez Bravo, 25, of Urbandale, OWI- first offense; Humberto Reyes Tolentino, 51, of Fort Dodge, driving while license revoked; Cain James Andersen, 21, of Templeton, possession of marijuana, OWI- first offense, and possess or carry dangerous weapon while under influence; Cristian Remberto Paniagua, 25, of Jefferson, possession of marijuana and possession of methamphetamine; and Corey Allen Mutum, 27, of Carroll, possession of methamphetamine.
