In Greene County district court Justin Ray Lopez, 22, of Jefferson was sentenced May 5 to up to six years in prison after he changed his plea to guilty on drug-related charges. He was sentenced to five years in prison on a charge of possession of marijuana with intent to deliver and on a charge of failure to affix tax stamp; the two prison terms are concurrent. He was fined $750 with a $112.50 surcharge on each charge; the fines and surcharges were suspended. Lopez was sentenced to one year in prison on a charge of possession of marijuana- second offense. The prison term is consecutive to the other two terms. He was fined $315 with a $47.25 surcharge, not suspended. The court ruled Lopez is unable to pay restitution for his court appointed attorney’s fees or court costs. A charge of child endangerment was dismissed. (Sentencing: Honorable Adria Kester)
Tanisha Rice, 45, of Scranton was sentenced May 5 to 30 days in jail after she pleaded guilty to a charge of domestic abuse assault simple, amended from domestic abuse assault display or use weapon. All but two days of the jail term was suspended and she was placed on probation to Boone/Greene County Probation for one year. She must complete the Iowa domestic abuse program at her own expense. Rice was fined $105 with a $15.75 surcharge and a $90 domestic abuse assault surcharge. She must pay an amount not to exceed $300 for her court appointed attorney’s fees and $60 court costs.
In a separate case Rice was sentenced to two days in jail after she pleaded guilty to a charge of assault causing bodily injury, amended from assault with intent to inflict serious injury. The jail time is consecutive to the time in the previous case. She was fined $315 with a $47.25 surcharge. Sharletha Carol Wiggins, 57, of Perry was sentenced to 10 days in jail after she changed he plea to guilty to a charge of driving while license barred. She was fined $6256 with a $93.75 surcharge; both were suspended. A hearing has been scheduled to determine if Wiggins is able to pay restitution for her court appointed attorney’s fees and court costs. (Sentencing: McCarville)
Douglas Wayne Shutt, 60, of Grand Junction was sentenced to one year in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but 10 days of the jail time was suspended and he was placed on probation to Boone/Greene County Probation for one year. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail time. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Shutt was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay an amount not to exceed $600 for his court appointed attorney’s fees and $141.72 court costs. A charge of driving while license barred was dismissed. (Sentencing: McCarville)
Shayne Loren Pegg, 33, of Carroll was granted a deferred judgment May 6 after he changed his plea to guilty to a charge of possession of marijuana. He was placed on informal probation to the Greene County sheriff’s office for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay a $430 civil penalty, an amount not to exceed $600 for his court appointed attorney’s fees, and $100 court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignments during the week ending May 7 as follows: Jonathan Phillip Michael Kennedy, 33, of Bagley, burglary- second degree, and in a separate case, possession of methamphetamine- third or subsequent offense, and possession of marijuana- third or subsequent offense; Jordan Alexis Holley, 18, of Scranton, possession of marijuana, possession of a controlled substance, and unlawful possession of a prescription drug; Samantha Nicole Peel, 35, of Des Moines, driving while license barred; Zang Thang, 31, of Indianapolis, IN, interference with official acts causing bodily injury; and Jason Andrew Songer, 41, of Farnhamville, OWI. Trial dates were set for June 15 for Kennedy and Songer, and for July 20 in all other cases.
