In Greene County district curt Marcia Kay Lowe, 57, of Yale was sentenced April 23 to five years in prison after she changed her plea to guilty to a charge of possession of methamphetamine- third or subsequent offense. The prison term is concurrent to the term in another Greene County felony cases. Lowe was fined $1,025 with a $153,75 surcharge; the fine and surcharge were suspended. The court found her unable to pay restitution for here court appointed attorney’s fees or court costs. No disposition was entered on a charge of possession of marijuana- third or subsequent offense. A companion case in magistrate court in which Lowe was charged with possession of drug paraphernalia was dismissed with costs assessed to the state. (Sentencing: Honorable Joseph B. McCarville)
Ryan Douglas Patterson, 40, of Jefferson was sentenced April 21 to two year prison terms after he changed his pleas to guilty to charges of harassment- first degree and tampering with a juror or witness. The prison terms were suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. If the probation is revoked, the prison terms will be consecutive to the terms in six other Greene County cases. Patterson must live in a residential correctional facility until he attains the maximum benefit. He must follow any recommendations for drug treatment at his own expense. He was fined $855 with a $128.25 surcharge on each county. The court waived restitution for his court appointed attorney’s fees and court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignment as follows: Samantha Isabel Menjivar, 19, of Coon Rapids, operating while intoxicated; Justin Ray Lopez, 23, of Jefferson, flight to avoid prosecution; Brandon Lee Koius, 37, of Jefferson, possession of methamphetamine- second offense; Ryan Joseph Murphy, 40, of Jefferson, ongoing criminal conduct- influence enterprise, and possession of methamphetamine; and Sean Patrick Phillip Shell, 45, of Jefferson, ongoing criminal conduct- influence enterprise, and controlled substance violation. Murphy’s trial date was set for May 11. Trial dates of June 15 were set for Lopez and Kious, and for July 20 for Menjivar and Shell.
Information is available since the return of an arrest warrant that Jason M. Pixie, 39, of Callender has been charged with possession of marijuana- second offense and possession of methamphetamine- second offense. A warrant was issued for his arrest Jan. 25 and returned April 22.
Cases were initiated in district court as follows: Erica Kay Murphy, 30, of Jefferson, assault on person in certain occupation causing bodily injury; Jason Andrew Songer, 41, of Farnhamville, OWI- first offense; and Luke Wesley Craig Skalla, 31, of Bayard, operating commercial vehicle without a commercial driver’s license.
