In Greene County district court Crawford James Petterson, 19, of Jefferson was granted a deferred judgment after he changed his plea to guilty Dec. 13 to a charge of criminal mischief- fourth degree. He was placed on informal probation for one year. He must pay a $315 civil penalty, a $125 Law Enforcement Initiative surcharge, and $567 victim restitution. Court costs were $548.16. Shane Joe Spaulding, 40, of Bayard was sentenced to five years in prison on each of three charges – burglary- third degree, theft- second degree, and forgery. The prison terms on current; they were suspended and he was placed on probation for three years. He was fined $1,000 with a $350 surcharge and a $125 LEI surcharge on each of the charges. He must pay $3,262 victim restitution and $140 court costs. (Sentencing: Honorable Christopher C. Polking)
Christine Kay Moran, 47, of Perry was sentenced to five years in prison after she changed her plea to guilty to a charge of gambling- false claim of jackpot winnings. The prison term was suspended and she was placed on probation for three years. She was fined $750 with a $262.50 surcharge. Court costs were $872.67. (Sentencing: McCarville)
Michael Marlin Matthews, 24, of Grand Junction was fined $65 with a $22.75 surcharge after he changed his plea to guilty to a charge of criminal mischief- fourth degree. He must also pay $246.07 victim restitution and $444.28 court costs. (Sentencing: McCarville)
Kelvin Eugene Miller, 19, of Boone was sentenced to 180 days in jail after he changed his plea to guilty to a charge of possession of marijuana. The jail sentence was suspended and he was placed on probation for one year to Boone/Greene County Probation. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Miller was fined $100 with a $35t surcharge, as $10 surcharge for drug abuse resistance education (DARE), and a $125 LEI surcharge. Court costs were $100. (Sentencing: McCarville)
Sheral Louise Coppick, 61, of Carroll was sentenced to two years in prison after she changed her plea to guilty to a charge of operating while intoxicated- second offense. The prison term will be suspended after she serves seven days in the county jail. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. In lieu of two days of the jail time she may complete the Des Moines Area Community College 48-hour alcohol education program. Coppick was fined $1,875 with a $656.25 surcharge; the fine and surcharge will be waived if she obtains a temporary restricted license. She must pay a $10 DARE surcharge and $144.28 court costs. Maurice Darshaun Johnson-Wigley, 27, of Fort Dodge was sentenced to seven days in jail after he changed his plea to guilty to a charge of possession of marijuana- second offense. The jail time was suspended and he was placed on unsupervised probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Johnson-Wigley was fined $315 with a $110.25 surcharge. He must also pay a $125 LEI surcharge and a $10 DARE surcharge. Court costs were $100. (Sentencing: McCarville)
Garrett Rysavy, 21, of Jefferson was sentenced to two days in jail after he pleaded guilty to a charge of reckless driving, amended from OWI- first offense. He must pay $80 sheriff’s room and board for the time he serves. He was fined $65 with a $22.75 surcharge. He must pay $600 restitution for his court appointed attorney’s fees and $60 court costs. Kole Alexander Higgins, 25, was sentenced to five years in prison after he pleaded guilty to a charge of burglary- third degree. The prison term is concurrent to a term in another Greene County felony case. Higgins was fined $750 with a $262.50 surcharge and a $125 LEI surcharge; all three were suspended. Higgins was found by the court to be unable to pay restitution for his court appointed attorney’s fees or court costs. Victim restitution will be determined. (Sentencing: McCarville)
April L. Hose, 43, of Churdan was sentenced to two days in jail on a charge of possession of marijuana. She must also undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She was fined $100 with a $35 surcharge, a $125 LEI surcharge and a $10 DARE surcharge. Court costs were $100. Disposition was also entered on a charge of possession of drug paraphernalia in magistrate court. She was fined $65 with a $22.75 surcharge. Court costs were $90. Persons pleaded not guilty to charges as follows: Daniel Eduardo Westrum, 42, of Des Moines, forgery- habitual offender and theft- second degree- habitual offender; Kayden Allen Nelson, 18, of Carroll, possession of marijuana and operate without owner’s consent; Mark Allen Mendenhall, 47, of Fort Dodge, ongoing criminal conduct, theft- fourth degree, identity theft less than $1,500 (seven counts), and forgery (seven counts); Michael Joseph Hofbauer, 36, of Coon Rapids, OWI- first offense; Gary Wayne Lincoln, 60, of Dexter, OWI- first offense; Austin Taylor O’Connell, 21, of Jefferson, possession of marijuana and unlawful possession of prescription drug; Charles Andrew Kaufman, 55, of Perry, possession of marijuana- third or subsequent offense and possession of methamphetamine; David Allan Holley, 50, of Scranton, possession of marijuana- second offense; Richard Dean Tuhn Jr, 41, of Jefferson, burglary- first degree and assault causing bodily injury or mental illness; and Richard John Sabus, 56, of Churdan, driving while license barred. Trial dates were set for Jan. 28 for Mendenhall, Hofbauer, Lincoln and Kaufman. A trial date of Feb. 18 was set for Nelson. Trial dates were set for March 3 for O’Connell Holley, Tuhn and Sabus. A trial date of April 9 was set for Westrum.
Information is available with the return of an arrest warrant that Michelle Lynn Anderson, 45, of Mitchellville has been charged with theft- fourth degree, forgery, and identity theft less than $1,000.
