In Greene County district court Douglas Joseph Strang, 62, of West Des Moines was sentenced Nov. 8 to two years in prison after he changed his plea to guilty to a charge of operating while intoxicated- second offense. All but seven days of the prison time was suspended and he was placed on probation for two years. He must complete a community college drinking drivers school, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of two days of the jail time. Strang was fined $1,875 with a $656.25 surcharge; one-half will be waived if he obtains a temporary restricted driver’s license. He must also pay a $10 drug abuse resistance education (DARE) surcharge and $304.86 court costs. (Sentencing: Honorable Joseph B. McCarville)
Justin Harvey, 18, of Grand Junction was granted a deferred judgment after he entered an Alford plea to a charge of criminal mischief- fifth degree, amended from criminal mischief- third degree aiding and abetting. In entering an Alford plea a defendant does not admit committing a crime, but believes that given the facts in the county attorney’s information, a jury would find him guilty of the crime. Harvey will be on probation to Boone/Greene County Probation for one year. A civil penalty of $65 was suspended. He must pay $425 victim restitution, a $125 Law Enforcement Initiative surcharge, up to $1,200 restitution for his court appointed attorney’s fees, and $632.72 court costs. (Sentencing: McCarville)
Johnnie Richard Phipps, 38, of Ames was sentenced to two years in prison after he changed his plea to guilty to a charge of driving while license barred. The prison term was suspended and he was placed on probation for one year. He was fined $625 with a $218.75 surcharge; both were suspended. Charges of possession of marijuana- third or subsequent offense and child endangerment were dismissed. A charge in magistrate court of possession of drug paraphernalia was also dismissed. Daryn Joseph Mallory, 54, of Jefferson was sentenced to two years in prison after he changed his plea to guilty to a charge of OWI-second offense. All but seven days of the prison term was suspended and he was placed on probation for two years. He must complete a community college drinking drivers school, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Mallory was fined $1,875 with a $656.25 surcharge; both were suspended. He must pay a $10 DARE surcharge and restitution for his court appointed attorney’s to be determined but not more than $1,400.
