In Greene County district court Robert Alan Fry, 55, of Jefferson was sentenced Jan. 29 to 10 days in jail after he pleaded guilty to a charge of operating a motor vehicle without a valid driver’s license, amended from driving while license revoked, and interference with official acts, amended from interference with official acts causing bodily injury. He was sentenced to 10 days in jail on the operating charge, with credit for time served except for two days. He was also sentenced on a probation violation charge on an older case. In that case, he was sentenced to 253 days in jail, with credit for 251 days already served. The two remaining days of jail time are concurrent. Fry was fined $315 with a $110.25 surcharge; both were suspended. Fry must pay a $125 Law Enforcement Initiative surcharge, a $10 surcharge for drug abuse resistance education (DARE), and $1,035.54 court costs. (Sentencing: Honorable Joseph B. McCarville)
Jeremy Lee Benedict, 28, of Perry was sentenced to seven days in jail after he changed his plea to guilty to a charge of possession of methamphetamine. The jail time was suspended and he was placed on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Benedict was fined $315 with a $110.25 surcharge, a $10 DARE surcharge and a $125 LEI surcharge. He must also pay $324 restitution for his court appointed attorney’s fees and $214.24 court costs. Ruth Marie Fischer, 43, of Paton was sentenced to two days in jail after she changed her plea to guilty to a charge of operating while intoxicated- first offense. She must pay sheriff’s room and board fees for the time she serves. She must also complete the recommendations of a substance abuse evaluation she has already undergone, and she must complete a community college drinking driver’s school. She may complete the Des Moines Area Community College 48-hour alcohol education program in lieu of the jail time and the drinking driver’s school. Fischer was fined $1,260 with a $437.50 surcharge and a$10 DARE surcharge. She must pay $600 reimbursement for her court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Christopher Richard Sowers, 46, of Grand Junction was sentenced to two years in prison on a charge of possession of methamphetamine- second offense and two years in prison on a charge of driving while license barred, concurrent. The prison terms were suspended and he was placed on probation for two years. He must undergo a substance abuse evaluation and a mental health evaluation and complete any recommended treatments at his own expense. Sowers was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $15 LEI surcharge on the drug offense, along with $180 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)
Persons pleaded not guilty at arraignments as follows: McKensie Rae Bess, 36, of Carroll, possession of marijuana- first offense; Neal W. Schoon, 55, of Bayard, domestic abuse assault impeded blood/air flow; and Michael Allen Olson, 57, of Jefferson, assault on person in certain occupation. Trial dates were set for March 5 for Bess and Olson, and for April 9 for Schoon.
Cases were initiated in district court as follows: Elisha Marie Mischke, 38, of Jefferson, false report of indictable offense to public entity; Garret Lane McDowell, 18, of Grand Junction, eluding; and Bradley Erik Purdy, 22, of Rippey, sex abuse second degree (two counts) and lascivious acts with a child- solicitation.
