In Greene County district court Mark David Burgart, 41, of Churdan was sentenced Feb. 11 to two years in prison after he pleaded guilty to a charge of theft- third degree, amended from burglary- third degree. The prison term was suspended and he was placed on probation for two years. Burgart was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $125 Law Enforcement Initiative (LEI) surcharge, restitution for his court appointed attorney’s fees to be determined, and $100 court costs. (Sentencing: Honorable Joseph B. McCarville)
Derek Eugene Ott, 36, of Jefferson was sentenced to five years in prison after he changed his plea to guilty to a charge of burglary- third degree. The prison term is consecutive to prison terms in two Greene County felony cases. He was fined $750 with a $262.50 surcharge; the fine and surcharge were suspended. He must pay a $125 LEI surcharge and $180 court costs.
In a separate case, Ott was sentenced to five years in prison after he changed his plea to guilty to a charge of theft- third degree, amended from burglary- third degree. That prison term is also consecutive the prison terms in the above case. He was fined $750 with a $262.50 surcharge; the fine and surcharge were suspended. He must pay a $125 LEI surcharge, $910.05 restitution, and $180 court costs. The judge ruled he is unable to pay restitution for his court appointed attorney’s fees in both cases. Nevin Wesley Reed, 26, of Grand Junction was sentenced to two years in prison after he changed his plea to guilty to a charge of operating while intoxicated- second offense. All but seven days of the prison term was suspended. He was placed on informal probation for one year. He must complete the recommendations of a substance abuse evaluation he has already undergone, and he must complete a community college drinking drivers course. His drivers license was revoked for 180 days. Reed was fined $1,875 with as $656.25 surcharge. Court costs were $100. (Sentencing: McCarville)
Eddie Jermane Lee, 35, of Fort Dodge was sentenced to two days in jail after he changed his plea to guilty to a charge of OWI-first offense. He must pay sheriff’s room and board fees for the time he serves. He may attend the Des Moines Area Community College Weekend Offender program in lieu of the jail time. He must undergo a substance abuse evaluation and complete any recommended training at his own expense. He was fined $1,250 with a $437.50 surcharge and a $10 surcharge for drug abuse resistance education (DARE). A charge of driving while license barred was dismissed. (Sentencing: McCarville)

The prison term was suspended and he was placed on probation for two years. He was fined $625 with a $110.25 surcharge and a $10 DARE surcharge. Dewayne Edward Phipps,30, of Ogden was sentenced to two years in prison after he changed his plea to guilty to a charge of driving while license barred. The prison term was suspended and he was placed on probation for two years. He was fined $625 with a $218.75 surcharge. Derek Eugene Ott, 36, of Jefferson, pleaded not guilty to a charge of ongoing criminal conduct (Class B felony). A trial date was set for Feb. 27.
Cases were initiated in district court as follows: James Harris, 30, of Woodward, domestic abuse assault causing injury or mental illness; and Courtney Lynn Morlan, 18,of Jefferson, unauthorized use of credit card less than $1,000.
