In Greene County district court Kathryn Lynn Welch, 52, of Grand Junction was granted a deferred judgment Oct. 28 after she changed her plea to guilty to a charge of possession of marijuana- second offense. She was placed on informal probation for one year and she must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. A judgment was entered for a $315 civil penalty with a $125 Law Enforcement Initiative (LEI) surcharge and a $10 drug abuse resistance (DARE) surcharge. She must also pay $500 restitution for her court appointed attorney’s fees and $100 court costs. A companion case in magistrate court in which Welch was charged with possession of drug paraphernalia was dismissed. Court costs in that case were $60. (Sentencing: Honorable Adria A. Kester)
Jasmine Fluker, 27, of Jefferson was sentenced to two days in jail after she changed her plea to guilty to a charge of possession of methamphetamine. The jail time was suspended and she was placed on informal probation for one year. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Her driver’s license was revoked for 180 days. A judgment was entered for a $325 fine with a $110.25 surcharge, a $125 LEI surcharge and a $10 DARE surcharge. Fluker must also pay $600 restitution for her court appointed attorney’s fees and $100 court costs. Another charge of possession of methamphetamine- first offense in a separate district court case against Fluker was dismissed. Court costs were $100 in that case. (Sentencing: Kester)
Kevin Armando Montoya, 20, of Jefferson was sentenced to five years in prison, consecutive to the term in another Greene County felony case, after he pleaded guilty to a charge of theft- second degree, amended from theft- first degree. The prison term was suspended and Montoya was placed on probation for five years. He is to reside in a residential correctional facility until he attains the maximum benefits. A judgment was entered for a $750 fine with a $262.50 surcharge and a $125 LEI surcharge. He must also pay restitution for his court appointed attorney fees to be determined, $500 restitution and $140 court costs. A companion case in magistrate court in which Montoya was charged with criminal mischief- fifth degree was dismissed. (Sentencing: Kester)
Rachel Lavonne Baker, 33, of Des Moines was granted a deferred judgment after she changed her plea to guilty to a charge of possession of methamphetamine- first offense. She was placed on informal probation for one year and must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. A judgment was entered for a $315 civil penalty and a $125 LEI surcharge. A charge of possession of marijuana- first offense was dismissed. Angela Dawn Beem, 45, of Webster City pleaded not guilty Nov. 2 to a charge of unauthorized use of credit card less than $1,000. A trial date was set for Jan. 24.
