In Greene County district court Joe Edward Blackmon, 40, of Jefferson was sentenced June 21 to two years in prison after he pleaded guilty to a charge of criminal mischief- third degree. The prison term was suspended and he was placed on probation for two years. He was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $125 Law Enforcement Initiative surcharge, $1,200 restitution for his court appointed attorney’s fees, and $198.72 court costs. Blackmon was initially charged with criminal mischief- second degree and criminal mischief- fourth degree. A companion case in magistrate court in which Blackmon was charged with theft- fifth degree was dismissed, with $60 court costs assessed to Blackmon. (Sentencing: Honorable Adria A. Kester)
Sergio Patino, 31, of Commerce City, CO, was sentenced to two days in jail after he pleaded guilty to a charge of possession of marijuana- first offense. He was placed on informal probation for one year and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Patino was fined $315 with a $110.25 surcharge, a $10 surcharge for drug abuse resistance education (DARE), and a $125 LEI surcharge. He must also pay $600 restitution for his court appointed attorney’s fees and $100 court costs. His driver’s license was revoked for 180 days. (Sentencing: Kester)
Heather Thelma Erwin, 35, of Jefferson was sentenced to 10 years in prison on a charge of manufacturing/deliver or possess with intent to manufacture or deliver methamphetamine. The prison term is concurrent to a term in a previous Greene County case in which Erwin’s probation was revoked. She was fined $1,000 with a $350 surcharge; both were suspended. She must pay a $125 LEI surcharge, a $10 DARE surcharge, and $584.28 court costs. The court found she is unable to pay restitution for her court appointed attorney. Nicholas Anthony Balderas, 24, of Jefferson was sentenced to 365 days in jail after he pleaded guilty to public intoxication- second offense, amended from public intoxication- third or subsequent offense. The jail time was suspended and he was placed on informal probation for one year. Balderas was fined $315 with a $110.25 surcharge. He must also pay $600 restitution for his court appointed attorney’s fees and $100 court costs. A companion case in magistrate court in which Balderas was charged with interference with official acts was dismissed, with a judgment entered for $60 court costs. (Sentencing: Kester)
Nathan Flinn, 23, of Rippey was sentenced to two days in jail and placed on informal probation for one year after he pleaded guilty to a charge of possession of marijuana. He must pay sheriff’s room and board fees for the time he serves, as well as a $315 fine with a $110.25 surcharge, a $10 DARE surcharge and a $125 LEI surcharge. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense, and his driver’s license was revoked for 180 days. Flinn also pleaded guilty to a charge of driving while license revoked. On that charge he was fined $1,000 with a $350 surcharge and a $10 DARE surcharge. He must pay $600 restitution for his court appointed attorney’s fees and $100 court costs. Charges of illegal possession of prescription drug and possession of methamphetamine were dismissed. A companion case in magistrate court in which Flinn was charged with possession of drug paraphernalia was dismissed, with a judgment entered against him for $60 court costs. (Sentencing: Kester)
Jacob Thomas Monthei, 17, of Jefferson was granted a deferred judgment after he pleaded guilty to a charge of possession of marijuana with intent to deliver- not for sale. He was placed on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. A judgment was entered for a $315 civil penalty, a $125 LEI surcharge, a $10 surcharge and $140 court costs. (Sentencing: Kester)
