Greene County district court, week ending May 27

In Greene County district court Lucas Ross Kelsey, 33, of Des Moines pleaded guilty at a hearing May 27 of forgery, amended from fraudulent practices-second degree. He was sentenced to five years in prison. The prison term was suspended and he was placed on probation for two years.

Kelsey was fined $750 with a $262.50 surcharge; both were suspended. A judgment was entered for a $125 Law Enforcement Initiative surcharge, $2,584.23 restitution to United Bank, and $477.03 restitution to the Greene County sheriff. Court costs were $753.93. (Sentencing: Honorable Adria A. Kester)

Zachary Wailes, 22, of Breda was sentenced to two years in prison after he pleaded guilty to a charge of possession of methamphetamine, amended from possession of methamphetamine-third or subsequent offense. The prison term is concurrent to terms in Carroll, Calhoun and Story County cases. He was fined $625 with a $218.75 surcharge; the fine and surcharge were suspended. A judgment was entered for a $125 LEI surcharge and a $10 drug abuse resistance education (DARE) surcharge.

Wailes was sentenced to another two year prison term after he pleaded guilty to a charge of eluding, amended from eluding while participating in a felony or causing bodily injury. That term is consecutive to the term in the possession charge, but concurrent to the Carroll, Calhoun and Story County terms. He was fined $625 with a $218.75 surcharge; both were suspended. The court determined Wailes is unable to pay $120 restitution for his court appointed attorney’s fees. A judgment was entered for $513 restitution to the Greene County sheriff and $292.10 court costs. (Sentencing: Kester)

A companion case in magistrate court in which Wailes was charged with possession of drug paraphernalia was dismissed. Court costs were $60.

Branden Gerrick Smith, 39, of Jefferson was sentenced to 60 days in jail after he pleaded guilty to domestic abuse assault-serious, amended from domestic abuse assault-third or subsequent offense. All but two days of the jail sentence was suspended. Smith must pay $48 per day in sheriff’s fees for the time he serves, and he must complete a batterers education program at his own expense. A judgment was entered for a $315 fine with a $110.25 surcharge and $213 court costs. Restitution for his court appointed attorney’s fees is to be determined. (Sentencing: Kester)

A companion case in magistrate court in which Smith was charged with assault-simple was dismissed. Court costs were $60.

Persons pleaded not guilty at arraignment as follows: Michael David Teeples, 23, of Jefferson, distributing drug near a school and failure to affix tax stamp; Steven Logan Dzuris, 29, of Jefferson, operating while intoxicated (OWI)-second offense; Craig A. Kinsey, 46, of Jefferson, possession of methamphetamine; Jared Dean Dennhardt, 27, of Jefferson, criminal mischief-second degree; Kaleb Lee Lentz, 21, of Scranton, driving while license barred; Sheldon Dean McMain, 19, of Boone, possession of marijuana; and Christopher Herbert Lawrence, 36, of Ames, possession of dangerous weapons and possession of methamphetamine-second offense. Trial dates were set for July 26 in every case.

Cases were initiated in district court as follows: Tyson James Ruth, 35, of Jefferson, burglary-third degree, and in another case manufacture, deliver or possess with intent to deliver methamphetamine, and possession of marijuana, in another case possession of methamphetamine, possession of stolen property, theft-second degree and criminal trespass; Joey Ann Godwin, 35, of Jefferson, burglary-third degree, theft-second degree, and in another case manufacture, deliver or possess with intent to deliver methamphetamine, and in another case possession of methamphetamine, theft-second degree, possession of stolen property and criminal trespass; Nicholas Scott Lytle, 32, of Jefferson, driving while license revoked; and Craig Allen Kinsey, 46, of Jefferson, domestic abuse assault impeding flow of air/blood.
