Greene County district court, week ending March 11

In Greene County district court Craig Darwin Presley, 55, of Lake View was sentenced March 11 to two years in prison after he changed his plea to guilty to a charge of operating while intoxicated (OWI)-second offense. All but seven days of the prison term was suspended and he was placed on informal probation for one year. He may complete an OWI Weekend Offender program in lieu of two days of the remaining jail sentence. He must also complete a community college drinking driver’s school and the recommendations of a substance abuse evaluation he has already undergone.

Presley was fined $1,875 with a $656.25 surcharge. He must also pay a $10 surcharge for drug abuse resistance education (DARE), restitution for his court appointed attorney’s fees in an amount to be determined, $48 per day for the jail time he serves, and $100 court costs. Damien Michael Schwering, 22, of Scranton was sentenced to two years in prison on a charge of domestic abuse assault (aggravated misdemeanor), amended from domestic abuse assault causing injury. All but seven days of the prison term was suspended and he was placed on probation for two years. He was fined $625 with a $218.75 surcharge; both were suspended. The court determined he was unable to pay $180 restitution for his court appointed attorney’s fees. Court costs were $116.50. (Sentencing: Kester)

Nicholas James Miner, 37, of Fairplay, CO, was sentenced after he changes his plea to guilty to charges of felon in possession of a firearm and possession with intent to deliver marijuana. On the firearm charge Miner was sentenced to five years in prison. The prison term was suspended and he was placed on probation for three years. He must reside in a residential correctional facility until the maximum benefits are attained. He is to be held in the county jail until space is available. He was fined $750 with a $262.50 surcharge.

On the marijuana charge Miner was sentenced to five years in prison, concurrent to the firearms sentence. The prison term was also suspended and he was placed on probation for three years. His driver’s license was revoked for 180 days. He was fined $750 with a $262.50 surcharge, a $10 DARE surcharge and a $125 Law Enforcement Initiative surcharge. He must pay restitution for his court appointed attorney’s fees in an amount to be determined and $140 court costs. (Sentencing: Kester)

Persons pleaded not guilty at arraignment as follows: Brianne Kara Aguilar Flores, 25, of Grand Junction, theft-fourth degree; Ronnie Neal, 37, of Marshalltown, possession of methamphetamine; and Sergio Patino, 31, of Commerce City, CO, possession of marijuana-first offense. Trial dates were set for May 10 in every case.

Information is available since the return of an arrest warrant that Jeremy Thompson, 22, of Waterloo has been charged with domestic abuse assault impeding blood/air flow. The warrant was issued April 21, 2015 and returned March 9.

Information is available since the return of an arrest warrant that Brittany Kay Smith, 28, of Jefferson and Patrick Michaell Kennedy, 31, of Jefferson have both been charged with domestic abuse assault-third or subsequent offense. The warrants were issued Feb. 8 and returned March 8.

Cases were initiated in Greene County district court during the week ending March 11 as follows: Jeffery Paul Olberding, 49, of Scranton, carrying weapons; Tesa Renee Binns, 19, of Jefferson, criminal mischief-second degree, assault on a person in certain occupations (three counts), and interference with official acts inflicting bodily injury; and Joseph Donald Andrews, 32, of Gowrie, possession of marijuana-second offense and carrying weapons.
