In Greene County district court Joseph Robert Hupp, 23, of Scranton on Dec. 7 was granted a deferred judgment on a charge of operating while intoxicated (OWI)-first offense. A judgment was entered for a $1,250 civil penalty; if he obtains a temporary restricted license one-half the fine may be waived. He was placed on informal probation for one year, and he must complete the recommendations of a substance abuse evaluation he has already undergone and complete a community college drinking drivers school. In a district court case in which Trey Darwin Tucker, 17, of Jefferson was charged with sexual assault-third degree (Class C felony), jurisdiction was waived to juvenile court and a petition alleging delinquency was entered. The date for an adjudicatory hearing will be set by a separate order of the court. Additionally, the security level of the reverse waiver investigation report was upgraded to Level 1. A disposition was entered against Jeremy Ernest Andrews, 27, of Jefferson after he pleaded guilty to a charge of theft-third degree, amended from burglary-third degree. He was fined $625 with a $218.75 surcharge; both were suspended. He must pay a $125 Law Enforcement Initiative surcharge and restitution to be determined. He was sentenced to two years in prison; the prison term was suspended and he was placed on probation for two years. Court costs were $100. In a companion case in magistrate court in which Andrews was charged with trespass and theft-fifth degree, the charges were suspended but a judgment was entered for $60 court costs. Tammy L. Kirk, 42, of Jefferson was sentenced to two days in jail after she pleaded guilty to a charge of OWI-first offense. She may complete the Des Moines Area Community College OWI Weekend Offender program in lieu of jail time. She must also complete the recommendations of a substance abuse evaluation already completed, and a community college drinking drivers school. She was fined $1,250 with a $437.50 surcharge and a $10 drug abuse resistance education (DARE) surcharge. She was found to be unable to pay $120 restitution for her court appointed attorney’s fees. Persons pleaded not guilty at arraignments as follows: Jacob Benjamin Brown, 24, of Harlan, OWI-second offense; Jessica Amber Montoya, 20, of Churdan, domestic abuse assault causing injury or mental illness; and Katie Leora Halligan, 21, of Jefferson, OWI-first offense and possession of marijuana. Trial dates were set for Jan. 26 in every case.
