Greene County district court, week ending Sept. 11

In Greene County district court Matthew Lynn Durbin, 23, of Jefferson was granted a deferred judgment after he changed his plea to guilty to a charge of operating while intoxicated (OWI)-first offense. He must pay a civil penalty of $1,250; half will be waived if he obtains a temporary restricted license. Durbin will be on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense, and he must complete a community college drinking drivers course. Court costs were $100. Travis Ryan Armstrong, 26, of Jefferson was sentenced to two days in jail after he pleaded guilty to a charge of possession of marijuana-second offense. The jail time was suspended and he was placed on informal probation for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. His driver’s license was revoked for 180 days. Armstrong was fined $315 with a $110.25 surcharge, a $10 DARE (drug abuse resistance education) surcharge and a $125 Law Enforcement Initiative surcharge. Court costs were $100. (Sentencing: Kester)

Ricardo Emmanuel Rodriguez, 29, of Jefferson was sentenced to 365 days in jail after he pleaded guilty to a charge of public intoxication-second offense, amended from public intoxication-third offense. The jail time was suspended and he was placed on probation for two years, concurrent to probation in another Greene County case. Rodriguez is to reside in a residential correctional facility until he receives the maximum benefit, and he is to be held in jail until space is available. He must undergo a substance abuse evaluation and complete any recommended treatment. Rodriguez was fined $315 with a $110.25 surcharge. The court found him unable to pay restitution for his court appointed attorney’s fees. Court costs were $100. (Sentencing: Kester)

Persons pleaded not guilty at arraignment as follows: Brandon Michael Mitchell, 23, of Jefferson, fraudulent practice-third degree; Angela Bonnette, 24, of Jefferson, domestic abuse assault causing bodily injury; Richard Charles Burkhardt, 46, of Jefferson, criminal mischief-second degree and assault on a person in certain occupation; Cory Ray Seeman, 27, of Rippey, possession of marijuana-first offense; and Jerry Wayne Kobrock, 64, of Des Moines, driving while license barred. Trial dates were set for Nov. 3 in every case.

Cases were initiated in district court as follows: Jeremy Ernest Andrews, 27, of Jefferson, burglary-third degree; George R. Byerly, 56, of Jefferson, OWI-first offense; Bille Gaye Kucharo, 54, of Des Moines, OWI-first offense; and Brian Matthew Wolf, 36, of Jefferson, criminal mischief-fourth degree, and trespass causing injury or damage greater than $200.
