In Greene County district court Russell Lee Gardner, 40, of Jefferson was sentenced June 15 to two years in prison after he changed his plea to guilty to a charge of operating while intoxicated (OWI)-second offense. All but seven days of the prison time was suspended and he was placed on probation for two years. Gardner must pay a sheriff’s fee for the time he serves.
He must complete the recommendations of a substance abuse evaluation he has already done and attended a community college drinking drivers school. He was fined $1,875 with a $656.25 surcharge, a $10 surcharge for drug abuse resistance education (DARE), $90 restitution for his court appointed attorney’s fees and $100 court costs. A charge of possession of marijuana was dismissed, as was a companion case in magistrate court in which Gardner was charged with possession of drug paraphernalia. (Sentencing: Honorable Adria A. Kyle Alan Abernathy, 21, of Jefferson was sentenced June 15 to two years in prison after he pleaded guilty to a charge of operating a vehicle without the owner’s consent. The prison term was suspended and he was placed on probation for two years. Abernathy was fined $625 with a $218.75 surcharge. The fine and surcharge were suspended but he must pay a $125 Law Enforcement Initiative surcharge, $90 restitution for his court appointed attorney’s fees and $121 court costs. (Sentencing: Kester)
Persons pleaded not guilty at arraignment as follows: Polly Marie Bauer, 46, of Coon Rapids, OWI-first offense; and Delaney M. Spencer, 21, of Jefferson, OWI-first offense. Trial dates were set for Aug. 25 in both cases.
