Deferred judgment in fatal accident

Larry Lee Warren Varnell, 22, of Churdan was granted a deferred judgment on a charge of providing alcohol to a minor resulting in death, a class D felony. Sentencing was done in April 7 in Boone County district court by the Honorable James B. Malloy. Varnell had changed his plea guilty to the charge in January.

Varnell must pay a $750 civil penalty, $180 restitution for his court appointed attorney’s fees, and $219.04 court costs.

He was placed on probation for a term not less than two years but not to exceed five years. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Varnell may not enter any business establishment where the sale of alcohol constitutes more than 50 percent of the total sales.

The maximum penalty for a class D felony is five years in prison and a $7,500 fine.

Varnell was charged in connection with the death of Aaron Beaman, 20, of Jefferson Sept. 14 in Boone County. Beaman died in a one vehicle rollover accident. Evidence at the scene suggested Beaman was drunk at the time.

An investigation by Jefferson police officer Heath Enns (who was the first officer on the scene as a part-time Boone County sheriff’s deputy), and an Iowa State Patrol trooper showed that Varnell, Beaman, and another under age Greene County resident had spent the day together and that Varnell had purchased beer for the group.
