In Greene County district court Adam Bauer, 30, of Paton was sentenced Oct. 24 to two days in jail after he changed his plea to guilty to a charge of operating while intoxicated (OWI)-first offense. He must pay the sheriff’s room and board fees for the time he serves. He must comply with any recommendations from a substance abuse evaluation already completed, and he must also complete a community college drinking driver’s school. Bauer was fined $1,250 with a $437.50 surcharge and a $10 surcharge for substance abuse resistance education (DARE). Court costs were $100. (Sentencing: Honorable Adria A. Kester)
Edward Eugene Goff, 45, of Jefferson entered an Alford plea to a charge of assault-simple, amended from assault-serious. In entering an Alford plea, a defendant does not admit committing a crime, but believes that given the facts in the county attorney’s information, a jury would find him guilty of the crime. The case was initiated in district court but magistrate Rita Pedersen entered judgment. Goff was fined $100 with a $35 surcharge. He must pay victim restitution of $1,326.97, as well as $45 restitution for his court appointed attorney’s fees and $490.92 court costs.
Steven Wayne Busch, 58, of Fort Dodge was sentenced to five years in prison after he changed his plea to guilty to a charge of OWI-third offense. He is to be held at an OWI treatment facility. He must complete all recommended treatment and attend a community college drinking drivers school. His driver’s license is revoked for six years. Busch was fined $3,125 with a $1,093.75 surcharge and a $10 DARE surcharge. He must also pay $120 restitution for his court appointed attorney’s fees and $180 court costs. (Sentencing: Kester)
Alan Dale Ensley, 55, of Ankeny was sentenced to a total of four days in jail after he changed his plea to guilty to a charge of OWI-first degree and possession of methamphetamine-first offense, amended from possession of methamphetamine-second offense. On the OWI charge, he was sentenced to two days in jail and must pay sheriff’s room and board charges. He must complete any recommendations of a substance abuse evaluation and he must complete a community college drinking driver’s course. He was fined $1,250 with a $437.50 surcharge and a $10 DARE surcharge. Half the fine and surcharge will be waived if he obtains a restricted license. Ensley was also sentenced to two days in jail on the methamphetamine charge. The jail time was suspended and he was placed on informal probation for one year. He was fined $315 with a $110.25 surcharge, a $10 DARE surcharge and a $125 law enforcement initiative (LEI) surcharge. His driver’s license was revoked for 180 days. He paid $500 in court costs. A judgment was entered for $120 restitution for his court appointed attorney’s fees. (Sentencing: Kester)
Trinity Glen Welch, 25, of Grand Junction was sentenced to 30 days in jail after he pleaded guilty to a charge of criminal mischief-fifth degree, amended from criminal mischief-fourth degree. The jail time was suspended and he was placed on informal probation for one year. He was fined $65 with a $22.75 surcharge and a $125 LEI surcharge. He must also pay $500 restitution to the city of Grand Junction. He must pay restitution not yet determined and $100 court costs. (Sentencing: Kester)
In a case initiated in district court in which Heather Thelma Ott, 33, of Jefferson was charged with domestic abuse assault-serious, she pleaded guilty to an amended charge of assault-simple in magistrate court. He was fined $100 with a $35 surcharge. Court costs were $116.50.
Persons pleaded not guilty at arraignments as follows: Scott Dean Brackett, 49, of Jefferson, possession of marijuana-second offense; and Joshua James Schneider, 32, of Fort Dodge, driving while license revoked. Trial dates were set of Dec. 16 in both cases.
