Greene County district court, week ending Dec. 8

In Greene County district court Randy Dean Esslinger, 61, of Bayard was sentenced Dec. 1 to two days in jail after he changed his plea to guilty to a charge of operating while intoxicated (OWI)- first offense. He may complete a 48-hour weekend offender program in lieu of jail time. He must complete the recommendations of a substance abuse evaluation he has already undergone and he must complete a community college drinking drivers program. He was fined $1,250 with a $437.50 surcharge and a $10 surcharge for drug abuse resistance education (DARE). Court costs were $100. (Sentencing: Honorable Adria A. Kester)

Christopher Hollis Christian, 36, of Grand Junction was sentenced Dec. 9 to two years in prison after changed his plea to guilty to a charge of driving while license barred. The prison term was suspended and he was placed on probation for two years. Christian was fined $625 with a $218.75 surcharge. Restitution for his court appointed attorney is to be determined. Court costs were $100. A separate case in which he was charged with driving while license barred was dismissed. Court costs in that case were $100. (Sentencing: Kester)

Brice Neil Smith, 21, of Grand Junction was granted a deferred judgment Dec. 5 after he changed his plea to guilty to a charge of OWI- first offense. He was placed on informal probation for one year. He must follow the recommendations of a substance abuse evaluation he has already completed and he must complete a community college drinking drivers course. He must pay a civil penalty of $1,250; one-half will be waived if he gets a temporary restricted license. Court costs were $100. (Sentencing: Kester)

Person pleaded not guilty at arraignment as follows: Katelin Rae Lowmiller, 25, of Jefferson, driving while license barred; and Alex Cihera Frey, 31, of Madrid, OWI- first offense. Trial dates were set for Feb. 28 in both cases.

Cases were initiated in district court as follows: Chad Ryan Plath, 21, of Ogden, fraudulent practice- second degree, false reporting of financial transaction, unlawful betting- winnings more than $500 but less than $1,000; Amanda Sue Fitzsimmons, 35, no hometown given, prohibited acts- attempt to collect winnings from gambling game with intent to defraud; Richard J. Sabus, 53, of Churdan, theft- first degree, possession of stolen property (two counts); Alauna Nicole Sellers, 23, of Granger, domestic abuse assault causing injury- first offense; Douglas Duane Owen, 34, of Churdan, driving while license revoked; and Don Eugene Wallace, 78, driving while license revoked.
