Hearing scheduled in sex abuse case

The end of a sexual assault case that has weighed heavily on the minds of area residents is in sight. An adjudicatory hearing is scheduled for Tuesday, June 28, at 9 am in juvenile court for Trey Tucker, now 17, on a charge of delinquency. The notice of hearing was entered in Iowa Courts Online June 21.

Tucker was charged in district court last August with sex abuse -third degree, a class D felony. The case received much attention in some local media because Tucker is a high profile student athlete at Greene County High School. The state attorney general appointed a prosecutor to assist with the case.

Jurisdiction in the case was transferred to juvenile court in December and prosecution became the duty of Greene County attorney Nicola Martino.

After a petition by Tucker’s attorney, Judge William Ostlund last March closed the adjudicatory hearing and all documents to the public, finding that “the possibility of damage or harm to the juvenile outweighs the public’s interest in having an open hearing.”

Per Code of Iowa, the transcripts and proceedings of a closed hearing are not public documents. According to Greene County attorney Nicola Martino, that includes disposition of the case.
